1. Acceptance of Terms
By accessing the website of Rescue Packout ("Company," "we," "us," or "our"), utilizing our digital platforms, or engaging our packout, restoration, and storage services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.
2. Description of Services
Rescue Packout provides emergency contents triage, digital inventory, specialized packout, laboratory restoration (cleaning and deodorization), secure climate-controlled storage, and packback delivery services (collectively, the "Services") for residential and commercial properties in the Kansas City Metro and Denver Front Range areas.
3. Client Responsibilities & Site Access
To effectively perform our Services, you (the "Client") agree to:
Provide Safe Access: Ensure our technicians have safe, lawful access to the property to perform triage, inventory, and packout services.
Disclose Hazards: Notify our team of any known hazardous materials, biological threats, or structural dangers present on the property.
Identify High-Value Items: Explicitly identify exceptionally high-value or irreplaceable items (e.g., fine art, jewelry, cash, firearms, sensitive data devices) before the packout begins so specialized handling protocols can be applied. We reserve the right to refuse transport of cash, live animals, or illegal substances.
4. Pre-Existing Damage & Digital Inventory
Rescue Packout deals primarily with property that has been exposed to fire, smoke, water, or other disasters.
Condition Documentation: Prior to moving any items, we perform a Digital Inventory to document the "Pre-Loss" or "Pre-Existing" condition of your belongings via high-resolution photography and barcode scanning.
Liability Disclaimer: We are not liable for damage that occurred prior to our arrival, nor are we liable for "secondary damage" (such as mold growth or soot etching) that progresses inevitably due to the nature of the initial disaster, despite our best stabilization efforts.
5. Restoration Guarantees & Limitations
While we utilize state-of-the-art ultrasonic and molecular cleaning technologies, not all items can be saved.
Total Loss: If an item is deemed unrestorable, we will document it and provide a "Total Loss Manifest" for your insurance claim.
No Absolute Guarantee: We do not guarantee that every item will be restored to a "brand new" condition. Restoration is an effort to return the item to its pre-loss state or better.
6. Billing, Payments, and Insurance Coordination
Insurance Claims: As a courtesy, Rescue Packout uses industry-standard Xactimate pricing and works directly with your insurance carrier or adjuster to facilitate payment.
Ultimate Responsibility: You acknowledge that the contract for services is between you and Rescue Packout. If your insurance carrier denies coverage, caps your policy limits, or fails to pay for services rendered, the Client remains fully responsible for all outstanding balances.
Deductibles: The Client is responsible for paying any applicable insurance deductibles directly.
7. Storage and Abandoned Property
Items stored in our secure vaults are subject to monthly storage fees (often covered by insurance during the reconstruction period).
Packback Scheduling: Once your property is ready to receive the restored items, you must schedule a "Packback" within a reasonable timeframe.
Abandoned Property: If storage fees remain unpaid for a period exceeding 90 days, or if the Client becomes entirely unreachable, Rescue Packout reserves the right to consider the property abandoned. We will follow all applicable state laws in Missouri, Kansas, or Colorado regarding the legal liquidation, donation, or disposal of abandoned property to recoup unpaid storage and restoration costs.
8. Limitation of Liability
To the maximum extent permitted by law, Rescue Packout's liability for any loss or damage to property while in our care, custody, or control is limited to the actual cash value of the item, or the cost of repair, whichever is less, unless a separate declared valuation agreement has been executed in writing prior to the packout.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which the service was performed (Missouri, Kansas, or Colorado), without regard to its conflict of law provisions.
